About the role
The Marketing Counsel will act as the primary legal strategist enabling Oneapp's marketing engine to operate at speed while protecting the company from risk. In this role, you will translate complex legal requirements into practical guidance that unblocks campaigns instead of slowing them down. You will own the end-to-end compliance and defensibility of marketing initiatives across channels, from concept to launch. You will partner daily with cross-functional stakeholders to shape creative direction within clear regulatory guardrails. You will build and refine playbooks that allow marketing to move quickly without needing constant legal intervention. This position requires comfort with ambiguity and the ability to make high-quality decisions under tight time constraints. You will be responsible for ensuring that every customer promise is both compelling and fully substantiated.

What you'll do
- Serve as the primary in-house legal partner to the marketing, brand, design, paid media, and product teams, providing real-time counsel that keeps campaigns moving efficiently.
- Translate advertising and consumer protection laws into practical checklists and workflows that enable fast execution while reducing risk.
- Advise on the responsible deployment of advertising technology, consumer data practices, and privacy compliance across the full ad stack under CCPA/CPRA and other evolving state privacy laws.
- Guide the company on the appropriate use of consumer data, including PII handling, targeting limitations, and required disclosures.
- Structure and negotiate creator, influencer, and brand collaboration agreements while ensuring adherence to FTC endorsement rules and platform terms.
- Draft and review social media content, usage rights, and release forms to protect the brand and clarify ownership of creative assets.
- Design and review rewards, sweepstakes, contests, and promotions, including official rules, registration procedures, and multi-state bonding requirements.
- Provide clear guidance on affiliate and partner marketing programs, focusing on disclosure obligations, tracking mechanisms, and payout structures.
- Support end-to-end production and content development, including talent releases, music licensing, rights clearances, and vendor agreements.
- Develop and refine claim substantiation frameworks, working with product and marketing to evaluate puffery, comparative claims, and supporting evidence.
- Leverage AI tools to streamline contract review, marketing legal workflows, knowledge management, and pattern recognition across repetitive issues.
- Build lightweight, stage-appropriate processes and self-serve guidance that scale with marketing velocity and program complexity.
- Act as the legal owner of disclosure frameworks and compliance documentation related to advertising and data practices.
- Identify emerging regulatory trends and translate them into proactive controls that protect the business without stifling innovation.
- Collaborate with cross-functional leaders to influence strategic decisions, using clear communication and strong judgment at the highest levels.
Requirements
- Hold a J.D. and maintain active membership in good standing with a U.S. state bar.
- Bring 8+ years of legal experience, with at least 6 years focused on marketing, advertising, and/or ad technology law.
- Demonstrate deep, hands-on command of advertising and consumer-protection law, including FTC Act and UDAAP principles.
- Show extensive experience with promotions, sweepstakes, contests, and the regulatory requirements governing those programs.
- Have a proven track record advising on endorsement and influencer marketing, including FTC disclosure rules and rights clearance.
- Possess sophisticated knowledge of affiliate marketing structures, tracking practices, and associated legal obligations.
- Exhibit strong drafting and negotiation skills across agency, vendor, talent, and partnership agreements, with meticulous attention to detail.
- Have direct experience working with C-suite and executive leadership, influencing high-stakes decisions and communicating effectively at senior levels.
- Show fluency with AI tools and a proactive approach to using technology to improve legal throughput and quality.
- Operate with an act-like-owner mentality, taking initiative and accountability in ambiguous and fast-moving situations.
